What is a Set Aside Judgement?

A Set Aside Judgment is when an individual or business fails to respond to a Court claim, a default judgment (County Court Judgment - CCJ) may be entered against them without considering their defence. 

The court must set aside a default judgment under the following circumstances which our expert solicitors can assist with.

  • The Defendant can demonstrate they submitted an acknowledgment of service or a defense within the specified time limits
  • The Defendant applied to the court for a summary judgment before the CCJ was issued
  • The Defendant served an admission of liability to the Claimant prior to the CCJ being entered
  • The Defendant has already resolved the claim
  • The Defendant has requested the Claimant's case to be struck out
